Automobile, Truck, and Motorcycle Accidents

The most common type of personal injury lawsuitis one arising from an automobile, trucking, or motorcycle accident.  Numerous statutes and laws apply to these types of cases, but in general, the law of negligence governs these types of accidents.  A motorist is required to use “reasonable care under the circumstances.”  This is frequently defined as: (a) maintaining a proper lookout, (b) maintaining a proper speed, and (c) maintaining proper control of one’s vehicle.  The failure to meet any one or all of these duties can constitute negligence.

Vehicular accidents can arise from a wide variety of facts and circumstances.  Because of this, an early and thorough investigation is essential to succeeding on both liability and damages.  At a minimum, this includes:

            ·  photographs of the vehicles
            ·  photographs of the accident scene
            ·  interview any witnesses
            ·  interview the police officer
            ·  obtaining all medical records and diagnostic films after the accident
            ·  obtaining all medical records from before the accident
            ·  interviewing treating physicians

Further, vehicular accidents often involve insurance coverage issues.  Some times these issues can be straight forward; other times, they involve complex issues of contractual and statutory interpretation.

It is also important to note that if a case is not settled, the negligent driver’s insurance company will almost always retain a lawyer to represent their driver.  Accordingly, a victim of a vehicular accident can be at a significant disadvantage if he or she pursues the case without a lawyer.
